On the basis of instructions from the Governorship of Fethiye, the Ölüdeniz Municipality took decisions for the demolishment of 150 business centres and residences. While the decision is relayed to all addresses concerned, the time allowed to legalize the buildings came to an end of the 31st of December,. 2009.
A shock of demolishment is experienced at Ölüdeniz, which is a prominent Turkish tourism centre. The Ölüdeniz Municipality sent notices to owners of approximately 150 buildings to be demolished, stating that the time allowed for the legalization of these buildings expired on the 31st of December and that all of them were to be demolished and the cost of demolishment would be collected from the owners with 20 per cent interest.
The notices sent to owners of the buildings are based on the circular sent by the Governorship of Fethiye dated the 12th of October, 2009, in connection with illegal constructions and contain the following instructions: “The construction you have started or additions you have made to existing buildings within the boundaries of our municipality without obtaining the required permit were sealed up as per particle 32 of the Law No 3194 on Public Development and you were advised to legalize it.
In so far as the illegal construction and/or addition was not legalized within the time indicated in our previous notice, Our Municipal Council took a decision for a fine on the basis of article 42 of Law 3194 and for demolishment as per article 32 of the said law. The decision of the Municipal Council for the fine and demolishment was forwarded to you and you were repeatedly warned that you had to legalize your construction and play the fine to our municipality.”
Ünsal Erişgen, the Acting Mayor of Ölüdeniz, pointed out that the governorship was following up the matter closely and asked for demolishment of illegal constructions at Fethiye and Ölüdeniz.
Erişgen further stated that the Governorship of Fethiye had sent them instructions in this regard, adding, “If the mayors do not abide by these instructions, they may be sent to court and sentenced to 5 years of imprisonment. Therefore we forwarded the notices to the owners of the buildings. The Governorship of Mugla has been sending us circulars in this connection for the last 6 months. In our last meeting we had asked for and obtained an extension of time until the 31st of December and advised all the owners of the buildings. The time is up now. I hope we shall not be obliged to carry out the demolishment, because approximately 150 buildings are involved, which means that Ölüdeniz will be in ruins. We are contemplating going up to the Governor together with owners of these buildings. This is not a decision taken on the initiative of the Ölüdeniz Municipality but has its roots at the Ministry of Interior Affairs.”
